The Contrywide Home Retention Team Deception

AI Highlights
  • - Countrywide's CEO and team should be jailed.
  • - Forbearance agreements should be outlawed.
  • - Corruption charges should apply to those involved.

Countrywide's Home Retention Team should be thrown in jail with the CEO..Forbearance Agreements should be outlawed, and the Attorney General should have stepped in long ago. Throwing the CEO of Countrywide in jail is not enough.

Corruption charges should have been filed on everyone that was involved illegal practices. Duping consumers into coming up with huge amounts of money then without blinking an eye continuing to foreclose on their homes is unbelievable. Where is the justice? The entire legal system needs some serious attention.

I am very disappointed in our system. An Attorney I hired told me that there is no justice for the middle class...How SAD..

Govt.program to help homeowners is based on gross income and not net. No account for actual income.

AI Highlights
  • - Mortgage mods use gross income.
  • - Net income is $3000 less than gross.
  • - Payments are about 50% of net.
  • - Foreclosure is suggested.

The govt. program to help struggling homeowners modify their mortgages to 31% of their income is stupitly based on gross income.

So when you apply the payment to the percentage of your net income, its actually 50% or more of your actual take home income. This is wrong.Countrywide modified my mortgage at 31% of Gross, and my Net household income is actually $3000.00 less than gross income. So I am still giving them 50% of my net pay, and things are just as hard, also they are refusing to consider lowering the interest rate by a couple of points and possibly helping make the payment affordable. They say they are not obligated to help and I should consider other options like letting them foreclose and throw us out with 2 kids.

I have been fighting them for months. They are now Bank of America and they care even less. The presidents plan never took into account paying state and federal taxes and medical insurace for family and social security, 401K retirement, life insurance. None of that.

The gross pay looks great on paper but in reality we cant pay our bills with it. The presidents plan gave the banks who helped put the housing industry where it is today, a way out of trully helping hardworking people stay in their homes. Dropping interest rates by just a couple of points would be the easiest and most effective way to make a mortgage payment more affordable and banks are refusing to go that way. My bank is getting 1800.00 a month in just interest.

Its really hard to make even with two jobs.

I just think the presidents plan is way off reality. We are not all millionaires like him.

Countrywide--#!!..##**

AI Highlights
  • - Countrywide is a terrible company that only wants money.
  • - They denied relief on an adjustable loan; the servicer won't help.

Where to start about Countrywide.....they are a terrible company. The company only wants your money, lacking and care or concern for consumers.

I have tried to have the interest on a adjustable reduced. I have been turned down due to the difference between the selling price and actual price(upside down). Yes, two yrs ago I refin with belief I could refin again at a lower rate. I have been going around and around.

Countrywide is the servicing company.....only they don't know how to service.

Personally I hope they go out of business, or bk. Hope u don't lose your houses, don't plan on any assistance from Countrywide.

Who ever wrote this post. What you just described is known in the industry as "predatory Lending", and is strictly forbidden by Federal, and State Statutes.

Countrywide leads the pack when it comes to these practices. You should talk to Steve at Endless Fraud Detection. These guys are tough on these banks and feel the same way you do when it comes to their treatment of the American homeowner. What countrywide and others have done is nothing shy of treason.

They have wages an economic war on the American middle class. The only way to fight back is to challenge their claim. You say they are the "servicer". the servicer has NO LEGAL RIGHT TO CLAIM unless they are the holders of the note AND the security instrument in due course of law.

Countrywide has sold your note to some investor, or it is sitting in a pool somewhere. Not being able to "produce the note" is only one issue. Many more issues pop up when these mortgage contracts are audited. When banks break the law THEY OWE YOU MONEY.

Chances are Countrywide has commuted several "Resindable Violations". This is as common as hair on a dog.

If they commit 1 of these violations they owe you ALL of the money you paid them from the beginning, and they have to divest themselves of any and all security interest in the property. Really get ahold of this guy steve@***.com they are really good at this.

AI Highlights
  • - Countrywide wouldn't remove the $50 PMI without an appraisal fee.
  • - House would have qualified; prices fell.
  • - I took a second loan for flood repairs.

countrywide refuses to remove the 50 dollar pmi insurance unless i paid their high appraisal fee. my house would have qualified.

now it will not since house prices dropped and i had to take out a second loan for flood repairs. then i found many others who also had this same problem. and now they accept other appraisal companies. they are crooked and i am losing 50 dollars a month to them.

ripoffs.

they also set up an agreement with iowa to delay payments for flood victims. catch is you then owe all the payments at once.not doing that.

Trust me on this issue. Go through your states attorney general on this.

I have had great success with this procedure on all my consumer problems, what the heck it's free, what are you losing.

If the states attorney general cant mediate, they back yo up in a court of law! How good a chance you have now.

Countrywide Mortgage company

AI Highlights
  • - Requests a loan modification to keep the home.
  • - Seeks resolution to avoid foreclosure and keep home.
  • - Reports bankruptcy and income challenges.

August 28, 2009

Dear Countrywide (OFFICE OF THE PRESIDENT), (Mr. Colin), (OFFICE OF THE PRESIDENT), ANYONE ELSE WHO READS THIS LETTER,

Who Am I well , let me start with I have written at least 10 letters in the past 3 years last one June of 2008. My correspondence with country wide is via phones and letters and faxes. Phone calls come with miss information and nothing ever comes of it. As per my last conversation on August 27 2008 with bankruptcy Rep Mike who told me my mortgage was paid thru October 2008 with no payment due until Nov 1 2008.

Now once again I am requesting a loan modification or any action to which would allow me to maintain my home and end my chance of losing my home. I was miss informed when I was getting my home loan I was forced to sign this loan because the Rep and sales agent threatened to sue me for breach of a contract. Prior to closing I was never informed that this loan would be a adjustable rate mortgage.

When I tried to leave they threatened to sue and said home owner would also.he also promised he would have me out and refinanced in 3 months. I felt like I choice at that point. There were a few other things like not receiving a HUD sheet of the cost of closing prior to settlement and I was I was told to only bring cashiers check for 700 but before settlement I was told the rep estimated wrong and I needed 3000 more. This took away the savings I had for future payment cushion. Right after I bought my home I was notified by that my homeowners policy was shut down cause the company went bankrupt. I was also involved in a car accident, and then I got laid off from my job. This all transpired in a 3 month period. None of which was caused by myself or would I want anyone else to go through. I contacted countrywide and explained everything to them also wrote letters. To no avail countrywide started foreclosing and my plight fell on deaf ears. Always was turned down for ever type of bail out plan. So on the day before house was to go to Sheriff sale I filed bankruptcy. Now one year later I am paying 1090 on the bankruptcy and my mortgage is to go up to 2500 in Nov. Also most letters in regard to amounts I am due to pay are wrong from when I call to check on the payments. Like phone call yesterday the Rep Mike said I didn’t owe any payments until Nov 2008. Maybe he is right or maybe he is wrong I have no way of knowing. All documents say I need to pay but he says no need for payment . Another Document I received yesterday states that I need to pay $7000 by November 2008.

I WANT TO KEEP MY HOME. I WANT COUNTRYWIDE TO MAKE THE MONEY THEY ARE DUE. I AM ON MY HANDS AND KNEES BEGGING FOR THIS. I don’t want to walk away like many have done. I feel an honest interest rate would work for you and for me. We both win this way I get my home and you get paid. I have owned 3 homes prior to this home and none were even one payment late. I have documentation to proof this.

There Isn’t much more that I can’ say or do. I don’t want to loss my children’s one place they are comfortable and take them to a location in our area where they will not thrive which is what is likely to happen if I can’t get you and countrywide to agree to some sort of resolution. Our area is prone to drugs and gangs crime we have as a family worked to keep my 8 and 11 year old away from these areas and our home is secluded and away from the city so my kids are sheltered in hopes of not falling into these circumstances. Moving them from the area to which they are not acclimated to living would have serious consequences to their future. My husband and I make ok money that if we were giving the opportunity to afford the payments we would make sure the house was paid every month. So really it is your choice as to whether or not you are going to allow us to continue to live in our home. PLEASE HERE OUR PLIGHT AND LET US KEEP OUR AMERICAN DREAM AND DON’T FLUSH OUR CHANCES DOWN THE TOILET. ALTHOUGH AFTER MUCH DEVOTION TO PROTECTING ONES FREEDOMS WHILE SERVING 12YEARS IN THE US MILITARYS I HAVE TOTALLY LOSS MY FAITH IN THERE REALLY BEING OPPERTUNITIES TO FUFULL ONES AMERICAN DREAM TO MAY FACTORS PRESENT AT LOSSING IT.

Countrywide Bank's incompetence will cost me big $ in IRS penalties

AI Highlights
  • - Do not deposit here; risk 5-25% IRS penalties and costs.
  • - Countrywide can't service specialized IRAs.
  • - They tagged funds as excess IRA contributions.

Do not deposit your $ here, unless you'd like to lose 5-25% of it in IRS penalties & pay your accountant to fight with them. Countrywide has no idea how to service specialized IRAs.

5 months after opening mine, they realized they couldn't service it. Then they categorize my $ as an excess IRA contribution to the IRS instead of just returning my $.

This set me up for major headaches: no apology, no making up for having screwed me.

What Countrywide will do is make sure clients suffer & pay big time for entrusting their $ to them. It's not just toxic mortgages with this bank but incompetence & negligence as well.

Countrywide fails to honor or notify HELOC

AI Highlights
  • - Countrywide froze my HELOC on July 3, 2008, denying a $34,998 withdrawal despite a $37,000 limit in good standing and harming Toll Brothers contract.

I would like to lodge a consumer complaint about the holder of my primary mortgage and my Home Equity Line of Credit (HELOC): Countrywide Financial. My account number is 17834****.

I have held a Home Equity Line of Credit, with a credit limit of $37,000, with Countrywide for one year. In that time, I have borrowed a total of $4,000 from the account, to cover wedding expenses. The loan balance has since been paid off with no late payments or other adverse activity.

With the intention of purchasing a larger home in 2009, I planned to rely on my HELOC as partial down payment for a contract with Toll Brothers builders. Prior to signing a contract with Toll Brothers, I contacted Countrywide Financial to ensure that my HELOC was still active, with a credit limit of $37,000. The answer from a Countrywide customer representative was that my credit limit was still being honored.

Countrywide Bank, in a department called Home Equity Loan Servicing (SV3225 – P.O. Box 10287, Van Nuys, CA 91410-****) received a check request from me on July 3rd for the amount of $34,998. Countrywide refused to honor this check, and instead froze my HELOC account that day from any further withdrawals. Their response is included here in its entirety:

Important Message about Your Loan

We are writing to let you know that recently a payment on a check against your home equity line of credit had to be denied.

What This Means

Check number 00604 in the amount of $34,998 was denied on July 03, 2008 because:

Your account no longer permits draws to be taken.

What You Need to Do

Please update your records accordingly.

What is important to note about this chain of events is that my account and credit limit were in good standing up until the very second I attempted to utilize the line of credit, at which point the account was ‘reviewed’ and frozen.

This is at best an ad-hoc and anti-consumer method of account review, and at worst a very obvious attempt to prevent the company from bleeding cash at the expense of customers in good standing.

While this activity is undoubtedly legal according to the terms and conditions of the HELOC (no doubt some clause allows them to freeze accounts at any time), I find it to be highly consumer unfriendly. At the very least, I feel cheated out of the $500+ in processing fees I paid for a now unusable HELOC.

The damage this has done to me is to put me in breach of contract with Toll Brothers, to whom I promised a 5% down payment on a new property in order for them to move forward and promise new construction. I believe I had reasonable expectation, and took sufficient precaution, to ensure that I was able to complete the terms of the contract I signed at that time (28 June, 2008) based on my HELOC. I will note that my HELOC account was in good standing on 28 June.

On the phone, Countrywide indicated that my account could be unfrozen only through a reappraisal of my property at my own expense, or through some signed affidavit of property exchange values by a licensed real estate agent.

I have other sources of potential funding for my new home contract, but I would like to submit this as further evidence of California State Attorney General’s contention of Countrywide’s consumer unfriendly practices and policies.

Thank you for your time and consideration.

Counrtywide helped steal my identity

AI Highlights
  • - Ex used my info to close a home; notary says proper ID; mortgage unpaid 5 months; Countrywide won't acknowledge; docs show my name but no signature.

An ex of mine went to their local office with his girlfriend and closed on a home using my information. I spoke with the notary that settled the deal and she denied the entire thing stating that she would never settle without proper id being presented by the potential buyers.

What a lie because I was 45 mins away working.

Beautiful example of CYA. Since then the ex hasnt paid the mortgage in 5 months and I am taking a hit for it. Still Countrywide refuses to acknowledge that a mistake was made and refuse to accept proof of my where abouts at the exact time and date of closing. I went on their website and printed out the loan documents they have on file every document is my name, but not my signature.

One document has my name spelled incorrectly and the other lets me know that this woman obviously thought my middle name was actually my first. I am still pursuing this matter but to everyone reading, protect your identity like you protect your child.

It seems that some lenders only have their eye on commission other than protecting consumers from identity theft.

Transferred Mortgage and didnt send letter.

AI Highlights
  • - Countrywide Mortgage sold my loan 5 months ago; no notice.
  • - I kept paying CW, but they didn't forward the payments to the new lender.

Countrywide mortgage sold/transferred my Mortgage 5 months ago / April 2008 and never sent me a letter (which is required by law that they do so within 30 days of transferring a mortgage).

Meanwhile, I was sending my payments to them and they were gladly accepting them and not forwarding them to the new lender. The new lender did send me a letter stating "welcome back" with an old account number but it was ignored due to the fact that it mentioned nothing about my mortgage being sold to them from CW Mortgage.

I then got a letter from my current lender stating an "intent to foreclose" if i did not come current with payments. I called CW and they informed me that they indeed made a mistake and that it would take them 30 + days to do "reasearch" and get the funds over to the new lender. Meanwhile, this negativity went on my credit report and CW took every bit of 30 + days to forward all those payments to the new lender.

CW has poor customer service, you can hardly ever reach a Customer service rep, the automated customer line disconnects your call. They messed up my escrow account once they transferred it over to the new lender and that took over a month to get that straightened out as well. All i got was a verbal apology and that was it.

I spent countless hours on the phone trying to resolve this. I filed a complaint with Fed. Trade Commission who opened and investigation on CW.

This is an unacceptable way to conduct business. Anyone who has CW mortgage please contact them to see if you mortgage is still active with them and if not, please ensure that they have forwarded all funds necessary to bring your account up to par with your new lender.

This was very stressful to deal with and I can't tell you how many countless hours I spent on the phone trying to resolve this. I can name every one in their customer serv. dept; becuase i spoke to them ALL.

Countrywide SUCKS!

AI Highlights
  • - Accidentally paid the equity line twice after a rep reversed one payment.
  • - Collection call, I paid again, then a 30-day late hit my credit.

I accidentally paid my equity line twice. It was an honest mistake and I called Countrywide and asked if they could reverse one of the payments. The very nice, apparently not very efficient representative, reversed my payment not once but twice.

I get a collection call from the same *** company a week later asking me where my equity payment is. Huh? This nice rep tells me "No problem, no worries," so I pay it again and then Countrywide hits my credit with a 30 day late. OH MY GOD! Are you kidding me. They have the recording of my call, right? They know I didn't ask for both payments back, right? They know it was their mistake, right? Too stinking bad for you was their response. On their best day, their average and on most days, they just suck. I wonder who'll get my loan when they get sued out of business for predatory lending and general sumness.

Stay clear, they'll eat your young and then ask you for a napkin.

You should have investigated loans and the mortgage process before you even got a mortgage. You said yourself you didn't read the papers very well.

One of the reasons the mortgage market is as bad as it is, is because people like you did not take the time to go online or any number of places and learn about mortgage loans. Why would you not educate yourself on the biggest investment you make in your life-your home?

I am very tired of people like you saying I didn't read the papers or nobody told me. Ignorance is not bliss is it?

In response to from Alaska - The debt settlement program should be secondard to paying your mortgage or rent, or putting food on the table. If you can barely afford your necessities, you should not have been in this program.

2nd of all, none of our clients have been scammed, and 3rd, you cannot contact them. We don't give out their information for privacy reasons. Your comments are so ridiculous, I doubt the fact that you were ever a client of ours. Most likely our competition.

Same thing with Francis Monague, I asked management to research this, and no money was ever pulled in that name. We don't do business this way.

Please only contact us if you are serious about becoming debt free.

We will take care of you properly. If you are truly struggling right now, and you are not sure you will have a place to live next month, you should hold off on this program.
